What is the Automatic Stay of Deportation?

The Automatic Stay of Deportation is a form of protection offered to a non-U.S. citizen who is currently facing deportation proceedings. In Louisiana, this Automatic Stay grants the non-citizen a period of time where they cannot be deported from the U.S. before the court or immigration officer has a chance to make a decision on the case. This is done to ensure that the laws of the country, as well as due process, are respected, and that the rights of the non-citizen are upheld. In the case of immigration, the Automatic Stay of Deportation gives the non-citizen the time to present any case for staying in the country, either through legal representation or through self-representation. This includes the possibility of presenting a case for asylum or for any other form of legal protection. For those who have an ongoing family or community support system in the U.S., this period of protection can be invaluable. At the same time, the Automatic Stay of Deportation is not a permanent solution, as a decision must be made on the case. In most cases the stay will be in place until the decision is made.
