What is employment-based immigration?
Employment-based immigration is a type of immigration law that allows immigrants to enter the United States with documents for the purpose of employment. This type of immigration requires foreign nationals to apply for and receive an employment-based visa from the United States State Department. In Tennessee, the United States Citizenship and Immigration Services (USCIS) is responsible for processing employment-based visa applications. To qualify for an employment-based visa, the foreign national must prove they have the necessary skills, qualifications, and abilities to fill a specific job position in the U.S. The USCIS processes and adjudicates the petitions and visas in the order of their priority dates. Priority dates are determined based on the type of occupation and the country of origin of the foreign national. In addition, the employer must prove that the foreign national will not displace any U.S. citizens or legal permanent residents from the job position. This is known as an “immigrant labor certification.” Employment-based immigration is an important part of the immigration system in Tennessee and throughout the United States.
