What are the requirements for an E-3 visa?
The E-3 visa is a special work visa for individuals from Australia who want to work in the United States. In order to qualify for an E-3 visa, individuals must meet the following criteria: First, they must have a job offer from an employer in the United States. The job offer must be in a specialty occupation, which is defined by the U.S. Department of Labor as “a professional occupation that requires the application of a body of highly specialized knowledge and the attainment of a bachelor’s degree or higher in the specific specialty.” Second, their employer must file a Labor Condition Application (LCA) with the U.S. Department of Labor. This form documents the wages and working conditions for the position they will fill and must be approved before an E-3 visa can be issued. Third, the individual must have the necessary qualifications for the job, as evidenced by their education, work experience, and/or licensure or other professional credentials. Finally, the individual must have an E-3 visa petition (Form I-129) approved by the United States Citizenship and Immigration Services (USCIS). Once an individual meets all of these requirements, they can apply for the E-3 visa at a United States embassy or consulate. The E-3 visa allows individuals to live and work in the United States for up to two years, and it can be renewed in two-year increments. Those on an E-3 visa are also permitted to bring their spouse and children to the United States.
