What is an H-2A visa?

An H-2A visa is a type of work visa available to foreign-born workers coming to the United States to work in temporary or seasonal agricultural-related jobs. It is issued by the U.S. Citizenship and Immigration Services (USCIS) and is only available to certain countries that have been approved by the Department of State. It is important to note that the H-2A program does not allow permanent immigration status. The visa is valid for a specific amount of time, depending on the work contract. Generally, visas are valid for up to three years, however, they can be extended with a valid job contract. The H-2A visa is often used by employers in New York and other parts of the United States who need temporary foreign-born workers to harvest and grow their crops. In order to be eligible for an H-2A visa, the individual must have a valid job offer from an employer in the United States. The employer must also prove that there are no other U.S. citizens or legal immigrants who are able and willing to do the job. Additionally, the job must be seasonal and temporary in nature, and employer must prove that their wages and working conditions meet the standards of the U.S. Department of Labor. The H-2A program is an important part of the New York immigration legal landscape and, if employers adhere to all the requirements for the visa, it can be a great way to facilitate the temporary hiring of foreign-born workers in the state.
