What is an adjustment of status?

An adjustment of status is a process in which an immigrant in Oregon can apply for a change to their immigration status, usually to receive a green card. This could be from a temporary visa to a permanent resident status. In order for an applicant to adjust their status, they will have to meet certain requirements including having an approved petition from an employer or family member, and having a valid visa or otherwise being eligible for a change. The petition must be filed with the United States Citizenship and Immigration Services (USCIS) and once approved, the applicant will then have to apply to the USCIS for an adjustment of status. The applicant will have to provide supporting documents and pass the required background checks. Once all requirements are met, the applicant will receive a letter stating the approval of the adjustment of status and be able to change their immigration status from a temporary visa holder to a permanent resident. In most cases, once the adjustment of status is complete, the applicant will also be eligible for employment in Oregon.
