What is the H-2B visa?
The H-2B visa is a nonimmigrant visa program that allows U.S. employers to bring foreign nationals into the United States to fill temporary jobs. The program is available to employers in all states, including Virginia, and is designed to fill jobs for which there are not enough qualified U.S. workers or to fill seasonal or peak-load needs. This type of visa is divided into two subcategories: the H-2B-1 and the H-2B-2. The H-2B-1 visa is for temporary or seasonal workers from any of the countries in the H-2B program. The H-2B-2 visa is for temporary or seasonal workers, who are already in the United States, or come from certain countries, including Mexico and Canada, that the U.S. Department of Homeland Security has determined to be in the highest need for this type of work. In order to obtain an H-2B visa, employers must first apply to the U.S. Department of Labor for a labor certification. The labor certification must specify a job offer and provide the wage offered to the foreign worker. Employers must also prove that they have sought to employ qualified U.S. workers but have been unable to do so. Once the labor certification has been approved, employers must then submit a Petition for Nonimmigrant Worker Form (also known as Form I-129), which must be approved by the U.S. Citizenship and Immigration Services. Once the visa is approved, foreign workers can work in the United States under the terms of the visa, including the specific employer, job duties, and duration of employment.
