What is an adjustment of status?
Adjustment of status is a process available to some immigrants who are already in the U.S. and are eligible to become permanent residents. In the case of family immigration, this process allows family members of U.S. citizens and lawful permanent residents to come to the U.S. and adjust their status to that of a permanent resident without having to return to their home country for an immigrant visa. This process is only available to applicants who are present in the U.S. when they file the application and who are already eligible for a visa or have an approved immigrant visa petition. In North Carolina, adjustment of status is available to immigrants who have a valid and current visa or who can prove that they were admitted as a legal permanent resident to the United States. The primary applicant must also meet various other criteria, including demonstrating proof of financial self-sufficiency and having a valid job offer or employment history in the United States. The application must be submitted to the U.S Citizenship and Immigration Services (USCIS). If approved, the applicant will be given a green card and become a lawful permanent resident.
