How do I remove the conditions on my permanent resident status?
If you are a permanent resident in Tennessee, you may be eligible to remove the conditions on your permanent resident status. This is commonly known as the “conditional permanent resident” status. To apply to remove the conditions on your permanent resident status, you must file Form I-751, Petition to Remove Conditions on Residence, during the 90 days before your conditional permanent residency expires. In addition to the Form I-751, you must also provide evidence that you entered into a valid marriage in good faith, such as birth certificates, proof of joint assets and debts, and evidence of a continuing relationship. If you are unable to file the Form I-751 with your spouse, for example if your marriage has been terminated, you may still be able to remove the conditions on your permanent resident status. You will need to provide documentation that can establish that you entered into the marriage in good faith. You may also need to provide documentary evidence that extreme hardship would occur if the conditions were not removed. You must also submit a $595 filing fee, and $85 biometric services fee.
