How do I remove the conditions on my permanent resident status?
If you are a permanent resident with conditional status in Washington, you need to remove the conditions in order to maintain your permanent resident status. The first step is to determine if you are eligible to apply to remove the conditions. To be eligible, you must have obtained conditional permanent residence as a result of marriage to a U.S. citizen or lawful permanent resident, or through investment. Once you determine your eligibility, you must file Form I-751, Petition to Remove Conditions on Residence. The form must be filed within 90 days before the second anniversary of your conditional permanent residence. It must include evidence of your continued marriage and a joint statement from you and your spouse that your marriage was entered into in “good faith”. You may also include other evidence of relationship, such as photographs, affidavits, and joint bank accounts. Once your form is received, the U.S. Citizenship and Immigration Services (USCIS) will review the petition. You may be required to attend an interview in order for USCIS to determine your eligibility. The decision on your petition will be mailed to you.
