What is an ICE detention?
ICE detention is an immigration law enforcement tool used by U.S. Immigration and Customs Enforcement (ICE) to detain individuals believed to be unlawfully present in the United States. ICE detainers are administrative documents, not criminal charges, that ask local law enforcement or jailers to hold someone suspected of a civil immigration violation instead of allowing them to be released. These detainers can keep individuals in custody for up to 48 hours, giving ICE time to take them into federal custody. ICE detention is used to detain both individuals and families. ICE operates detention facilities across the United States and also contracts with a variety of local jails, state prisons, private detention centers, and local law enforcement facilities. The detained families are often housed in special “family detention centers.” In California, ICE family detention centers are located in Adelanto, Bakersfield, and San Diego. An ICE detention can be requested for individuals who are suspected of violating immigration laws, including those who are in the United States without authorization, those with expired or revoked visas, and those with other unlawful statuses. In some cases, individuals who have already been deported may be detained if they re-enter the country illegally. When an individual is placed in ICE detention, they will be held until their immigration court case is resolved, or until they are deported.
