What is an ICE detention?

ICE detention is when a person is arrested by a branch of the federal government called Immigration and Customs Enforcement (ICE). ICE is part of the Department of Homeland Security and is responsible for enforcing the nation’s immigration laws. A person is arrested for being undocumented or suspected of being undocumented. People who are arrested by ICE are placed in detention centers, where they are held while their case is processed. ICE detention centers are similar to prisons, with the primary difference being that the detainees are not traditional criminal offenders. Instead, they are awaiting an immigration hearing that will determine if they can remain in the country. Detainees have limited access to legal help and can spend months or even years in the detention center as their case is decided. ICE detention centers exist in most states, including Delaware. In recent years, the number of immigrants detained in Delaware has grown. This has been attributed to the aggressive tactics used by ICE to target undocumented immigrants and to the high number of undocumented immigrants living in Delaware. Detention can have lasting impacts on the physical and mental health of detainees. Family members of the detained person may also suffer emotionally. For this reason, many family members advocate on behalf of their loved ones to hasten their release and prevent them from being deported. In Delaware, advocacy groups work to protect the rights of immigrants who are detained by ICE.
