What is an ICE detention?

ICE detention is a process whereby a person is detained by the United States Immigration and Customs Enforcement (ICE) agency as part of the U.S. government’s efforts to enforce immigration laws. An ICE detention can take place either on a temporary or permanent basis, depending on the individual’s immigration status. The detention is carried out with the aim of ensuring that the individual complies with the laws concerning their immigration status, such as the provision of an identity document or proof of legal permit to stay in the US. When an individual who is suspected of being in the US without a valid visa or other immigration documents is detained, ICE will first determine their immigration status.
