What is the process for applying for a U visa?

In California, those who have been the victims of certain types of crimes may be eligible to apply for a U visa. The purpose of the U visa is to allow crime victims to remain in the U.S. and assist law enforcement in investigating or prosecuting the criminal activity. The first step in applying for a U visa is to file a Petition for a Nonimmigrant Worker (Form I-765) with the United States Citizenship and Immigration Services. Along with this form, applicants must also submit evidence to demonstrate their victimization and cooperation with law enforcement. This evidence may include police reports, letters from law enforcement, or statements from witnesses. Once the applicant has filed the petition, they must obtain certification from a law enforcement agency that they have been helpful in the investigation or prosecution of the crime. This certification is known as the Law Enforcement Certification (LEC). Once the petition and LEC are both submitted, USCIS will review the application and decide whether to approve or deny the application. If the application is approved, the applicant will be granted a U visa which grants them temporary legal status and the ability to remain in the United States for up to four years. In addition to the U visa, applicants may also be eligible for other immigration benefits such as work authorization or permanent residency. Through the U visa program, immigrants and their families can rebuild their lives in the United States and benefit from the safety and security of U.S. laws.
