What is the process for traveling outside the US while my application is pending?
If you are applying for family-based immigration in California and would like to travel outside the United States while your application is pending, there are several steps that must be taken. First, you should consult with your immigration lawyer to make sure leaving the U.S. won’t jeopardize your status. Depending on the type of visa application you have submitted, it is possible that leaving the U.S. could result in the denial of your application. If your lawyer advises that you are safe to travel, you must apply for a re-entry permit. This permit will allow you to leave the U.S. and return without the need for a new visa. To apply for a re-entry permit, you will need to complete an I-131 form and submit copies of your current passport pages, a recent photograph, and proof that you have permission to stay in the U.S., such as a valid work authorization. You will also need to notify the U.S. Citizenship and Immigration Services that you will be temporarily traveling abroad. To do this, you must file an I-327 form, which will allow the USCIS to monitor your whereabouts while your application is pending. Finally, when you return, you must bring copies of all your travel documents, including your visas, passport stamps, and boarding passes. These documents will help prove that you were in the U.S. for a temporary visit and not for a lengthy stay. Be sure to bring these documents to your next immigration interview.
