How do I apply for an immigrant visa for a fiancé(e)?
In New Mexico, to apply for an immigrant visa for a fiancé(e) the United States Citizenship and Immigration Services (USCIS) requires that the petitioner submit Form I-129F, Petition for Alien Fiancé(e). The petitioner must also submit certain documents to prove that the relationship is bona fide and meets the requirements of the Immigration and Nationality Act. The petitioner must provide the following documents: proof of citizenship, such as a birth certificate, passport, or naturalization certificate; evidence that any prior marriages of each person have been legally terminated; evidence that the two parties have met in person within the past two years; written statement showing the petitioner’s intent to marry the beneficiary within 90 days of the beneficiary’s admission to the U.S.; and evidence that both parties are legally free to marry. Once the I-129F application and the required documents are complete, they must be submitted along with the applicable fee to the USCIS office that serves the petitioner’s area. After receiving the application and submitted documents, USCIS will review the evidence and make a decision. If approved, USCIS will send a notice to the petitioner along with an immigrant visa petition package for the beneficiary. The beneficiary will then need to apply for an immigrant visa at the U.S. Embassy or Consulate in their home country.
