What is a forum selection clause?
A forum selection clause is a type of legal agreement that outlines which jurisdiction will oversee a potential dispute. In the context of international litigation law in Washington, this clause determines which court has the authority to preside over an issue that is being contested between two parties. The clause will also determine which country’s laws will be used to settle the dispute. This clause is often included in contracts between parties to guard against potential litigation that might arise from the agreement. The forum selection clause allows the two parties to agree on the location and legal system ahead of time in order to avoid any disputes over the matter later on. It ensures the contract will be enforced by the same laws in the same court should a dispute arise, rather than potentially having to litigate the matter in multiple countries and multiple courts. This saves a great deal of time, money and resources. In Washington, the parties involved in an international litigation case must agree on this clause before any legal action can be taken. This allows the parties to decide where they would like the dispute to be resolved while also taking into consideration their own individual needs. This clause is an important component of the contract and, if agreed upon, it will be considered just as binding as any other component of the contract.
