What are the differences between international and domestic forum shopping?
International and domestic forum shopping are two similar legal strategies where a party (or parties) in a lawsuit try and select a court that will most likely be partial to their interests. Despite being similar in goal, the differences between international and domestic forum shopping arise from the different court structures of each type of lawsuit. In domestic forum shopping, parties search for a court within their own country that will best favor their interests. They may search for a court in a state that has a more favorable body of precedents that are more likely to sympathize with the party’s position. In addition, the judges in certain state courts may be more knowledgeable in the area of law involved in the suit. International forum shopping is different from domestic forum shopping because of the structure of courts located in countries outside of the United States. An international court will usually have different laws, language, and judges than those found in the United States. The parties involved in an international forum shopping lawsuit must understand the different laws and language of the court, as well as be familiar with the foreign judges and their judicial styles. Unlike domestic forum shopping, international forum shopping can involve a more complex and costly process, because the parties must be able to provide evidence in the language of the court. It is also more difficult to win an international forum shopping lawsuit, as judges in foreign courts may be less likely to side with a foreign party in a dispute. In conclusion, the difference between international and domestic forum shopping lies in the different court structures and aspects of each type of lawsuit. While both strategies are similar in goal, they require different legal processes in order to achieve success.
