What is a motion to dismiss in international litigation?
A motion to dismiss is a legal document filed in court that requests the court to dismiss a case. In international litigation, a motion to dismiss is used to challenge the court’s jurisdiction over a particular case or to determine whether or not a case should be heard by a court. In Massachusetts, when a motion to dismiss is filed, a hearing is usually scheduled to hear arguments from both sides.
