What is the role of the International Court of Justice in international litigation?
The International Court of Justice, or ICJ, is the judicial organ of the United Nations, and plays a key role in international litigation. As the world’s principal court for the resolution of disputes between countries, the ICJ is often the court of last resort in international disputes. The ICJ is the only international court that has the power to settle disputes between countries in the form of binding judgments. In order for the court to rule in a case, the countries involved must consent to be bound by its decision. This means that both countries have to agree to accept the decision of the court as legally binding. The ICJ has jurisdiction over disputes relating to international law, which includes matters such as the interpretation and application of international treaties, disputes over territorial sovereignty, maritime boundaries, diplomatic relations, and human rights. The ICJ can also issue advisory opinions to UN organs and specialized agencies. The decisions of the ICJ are binding, and countries agree to comply with the decisions of the court. In cases concerning the rights and responsibilities of member states, the decisions of the ICJ are enforceable. In California, litigation between countries can be resolved in US courts through the US State Department’s Office of International Litigation. If the dispute is not resolved through domestic courts, the parties can choose to resolve the dispute through the ICJ.
