What is a class action suit and when can it be used in international litigation?
A class action suit is a type of legal action where a single plaintiff, or a group of plaintiffs, sue a defendant or group of defendants on behalf of a group of people. In international litigation, a class action suit can be used when a large group of people has been affected by a similar issue, such as a faulty product, wrongful termination, or deceptive practices. Generally, when a class action suit is pursued, the goal is to represent the interests of the group and to protect the rights of each individual who has been affected by the issue at hand. In Colorado, a class action suit must meet certain criteria in order to be pursued. For international litigation, a proposed class action must meet the requirements of both the federal district court as well as the foreign jurisdiction. Additionally, each proposed class of plaintiffs must be clearly defined and the legal claims should be established. For international litigation, class action suits can be beneficial as they allow the affected group to pursue a claim without each individual suffering an increased financial burden. Although each individual plaintiff must still provide evidence of their individual claim, the group as a whole is more likely to achieve a successful outcome when the suit is successful.
