What is a default judgment and when can it be used in international litigation?
A default judgment is a form of resolution in a legal dispute when one of the parties does not respond in a timely manner. It is usually applied in civil and criminal cases but can also be used in international litigation. In Texas, a default judgment can be used when one of the parties to a lawsuit fails to respond to the court. The court will then enter a judgment in favor of the non-responding party, as if they had responded. This allows the lawsuit to be resolved without the other party being present.
