Is there a waiting period to get married to someone who is an immigrant?
In West Virginia, there is a waiting period to get married to someone who is an immigrant. The law stipulates that the immigrant must be in the United States for at least 90 days or more prior to the marriage. During that time, they must have a valid visa and must have obtained authorization from the U.S. government to stay in the country. In order to marry an immigrant in West Virginia, the couple must apply for a marriage license from the clerk of the county court in the area where the marriage will be performed. The couple must present valid identification and proof of residency, and both people must be present when the license is issued. In addition, the immigrant must present documentation verifying their legal stay in the United States. Once the marriage license is issued, there is no waiting period before the couple can get married. However, as part of the application process, the clerk may require the immigrant to provide proof that they have obtained the necessary legal documents to stay in the U.S. As such, they may need to wait until those documents are obtained before they can receive their marriage license. Additionally, if either partner has been married before, they must bring proof of that marriage’s dissolution to the clerk.
