How do I prove that my spouse and I have a valid, ongoing marriage?
In California, there are certain requirements that must be met in order to prove that your marriage is valid and ongoing. The most important requirement is proof of a bona fide marriage. To prove a bona fide marriage, you will need to provide evidence of your marriage, such as a valid marriage certificate, proof of your living together as a married couple, and any other relevant documents that prove your marriage is legitimate. You must also prove that both you and your spouse have a commitment to each other, including financial obligations and sharing of intimate moments like holidays or other special occasions. If you are married for Immigration Law purposes, you will also need to submit evidence that your marriage was not entered into for any fraudulent or other improper purpose. This includes proof that the marriage is for a purpose other than obtaining a green card. Examples of such proof include joint bank statements, joint tax returns, and shared leases. You should also be able to prove that you and your spouse have an ongoing, real-life relationship by providing documentation such as photographs and/or travel records together. Finally, you and your spouse must prove that you are living together in a valid, ongoing marriage by providing documents such as shared utility bills, a joint residence, and other evidence that you are indeed living together and in a relationship. If you are unable to provide this type of proof, your marriage may be deemed invalid and your green card application may be denied.
