What is a waivable ground of inadmissibility?

A waivable ground of inadmissibility is an immigration law that can prevent an individual from entering a new country. In the state of Washington, a waivable ground of inadmissibility can be used to deny a person admission into the United States if they are determined to be ineligible for a visa, permanent residency, or other form of legal immigration status. In regards to marriage, one of the most common waivable grounds of inadmissibility is establishing a fake marriage. If it is found that one or both of the parties entered into the marriage solely for the purpose of obtaining a visa, then the petition to obtain an immigration benefit will be denied. Additionally, if one of the spouses is already a citizen of the United States, they may be found ineligible if they are determined to have married an individual solely in order to provide them with a visa. It is important to note that although a ground of inadmissibility is waivable, it does not necessarily guarantee that the individual will be granted an immigration benefit. In order to be successful, the individual must be able to prove to the authorities that their marriage is genuine and not entered into for the purpose of obtaining a visa. This can be done by providing evidence of a shared residence, joint bank accounts and shared property, evidence of co-mingling of assets, and other evidence of a genuine marriage.
