What is a “T visa” and how do I qualify?
A T visa is a type of visa issued by the United States Citizenship and Immigration Services (USCIS) to people who are victims of human trafficking. To qualify for a T visa, you must meet certain criteria. These include being physically present in the United States due to human trafficking, showing that you would suffer extreme hardship if you were to be removed from the country, and that you complied with reasonable requests made by the government to assist in the investigation or prosecution of the human traffickers. In South Dakota, if you are an alien who is married to a US citizen or Lawful Permanent Resident, you may also qualify for a T visa. Your spouse would need to prove that they have been active in assisting the local law enforcement agency in identifying and apprehending those responsible for the human trafficking. Your spouse would also need to provide evidence of their own personal hardship that would be caused by your removal from the United States. In addition, you may also need to provide evidence of your own financial hardships. Once the USCIS approves the T visa, you may be allowed to stay in the United States and eventually obtain a green card.
