What is a “T visa” and how do I qualify?

A T visa is a type of legal status granted to victims of human trafficking in the United States. It is a nonimmigrant visa that allows the applicants to remain in the U.S. and obtain employment authorization. The visa is initially issued for a three-year period, and it may be extended for another four years with the possibility of applying for permanent residence. To qualify for a T visa in West Virginia, applicants must meet certain criteria. They must be a victim of a severe form of human trafficking, either forced labor or sex trafficking. They must have been trafficked into the U.S., or they must have been a victim of a severe form of trafficking in the U.S. The applicant must also demonstrate that they have been helpful to authorities in their investigation and prosecution of trafficking. Finally, applicants must provide evidence of a connection between the trafficking and marriage. They must demonstrate that their marriage to their trafficker was the result of coercion or fraud and that they are still married to the trafficker. If the marriage has been terminated, the applicant must show that it was due to circumstances created by their trafficker. T visa applicants must also demonstrate that they meet the admissibility requirements for the visa, such as not having a criminal record.
