Can I adjust my status if I entered the U.S. without a visa?
In South Dakota, it is possible for a person who entered the U.S. without a visa to adjust their status if they are eligible for legal permanent residency through marriage. This process is called an Adjustment of Status and can often be done concurrently with a marriage-based green card application. To be eligible, the foreign national must be the spouse of a U.S. citizen or lawful permanent resident. The foreign national must also have entered the U.S. with valid documentation, such as a passport and I-94 arrival record. The process will involve submitting an Adjustment of Status application along with several additional forms and supporting documents. These documents must be carefully completed and accurate in order to increase the chances of approval. If approved, the foreign national will be given a conditional permanent residency valid for two years. To remove the conditions on the residency, the couple must submit another application 90 days before the two-year expiration date of the card. The foreign national will need to provide evidence of the bona fide marriage, such as tax returns, bank statements, joint bills, and other documents. If the application is approved, the foreign national will be granted lawful permanent resident status and will be able to apply for citizenship after five years.
