What is the process for applying for a U-visa?
Applying for a U-visa in California requires a few steps. To start, the individual must file a Form-I-918, which is the official application for a U-visa. Supporting documents, such as proof of the applicant’s identity, must also be attached. The individual must also submit evidence that they have either been victims of a qualifying criminal activity or assisted law enforcement with an investigation into this crime. Additionally, the applicant must have a valid immigration status in the United States and must have been present in the US when the crime occurred. Next, the applicant must file Form-I-192, which is a form for requesting “advance permission to enter the United States.” This form is needed because the U-visa does not by itself give the individual permission to enter the US, and instead, requires the individual to ask for permission from the US government. Finally, the individual must complete Form-I-765, which is an application for an Employment Authorization Card, or “work permit.” This card is required for anyone who wishes to work in the United States and must be issued before any employment may begin. After all the paperwork is completed and submitted to the US Citizenship and Immigration Services, they will review and consider the application. After review, the USCIS either approves or denies the citizenship application. If approved, the applicant will receive their U-visa and be able to proceed with their life in the United States.
