What is the process for applying for a U-visa?
In Florida, the U-visa process is similar to other immigration applications. Like any other immigration application, the individual must first meet the eligibility requirements to receive the visa. In order to be eligible for a U-visa, the individual must have been the victim of certain types of criminal activity and be willing and able to help law enforcement or other government officials investigate and prosecute the crime. Once the individual has met the basic eligibility criteria, they can begin the U-visa application process. First, the individual must submit a completed Form I-918 Supplement B, which is the U-visa certification form. This form must be signed by a certifying agency, such as a law enforcement agency, prosecutor, or court. The certification form will provide information regarding the criminal activity and the individual’s willingness to assist with the investigation or prosecution of such activity. Additionally, the individual must submit a Form I-192 Application for Advance Permission to Enter as a Nonimmigrant. This form will provide additional information to the United States Citizenship and Immigration Services (USCIS) regarding the individual’s background and eligibility to receive the U-visa. Once the application is approved by USCIS, the individual will receive an immigrant visa and be allowed to enter the United States as a U-visa holder. This visa will remain valid for a period of four years. At the end of the four-year period, the individual must apply to have their visa renewed in order to remain in the United States legally.
