What is the process for applying for a “U” nonimmigrant status?
In California, there are certain steps one must take in order to apply for a “U” nonimmigrant status. First, one must submit Form I-918, Petition for U Nonimmigrant Status to U.S. Citizenship and Immigration Services (USCIS). The forms must be filled out accurately and completely and must include all relevant documents, such as evidence of having suffered substantial physical or mental abuse due to having been a victim of certain criminal activity. The USCIS will then review the form and may request additional information if needed. Once USCIS approves the form, the individual must file Form I-192, Application for Advance Permission to Enter as a Nonimmigrant. This form needs to be accompanied by a completed medical exam, two passport-style photographs, two copies of the passport and any other documents proving that the individual was the victim of a qualifying criminal activity. The individual will then receive a decision letter from USCIS outlining the status of their application and may be scheduled for an interview with a USCIS officer. Applicants may be asked to provide additional evidence of their status or situation. Once the interview is complete, the USCIS officer may approve or deny the application. If approved, the “U” nonimmigrant status will be granted and the individual may stay in the United States for up to four years.
