What is the process for obtaining a victims of human trafficking visa?

In Tennessee, victims of human trafficking are afforded special relief through the U.S. immigration process in the form of a Human Trafficking Visa, or a T visa. The process for applying for a T visa in this state involves submitting a petition to the U.S. Citizenship and Immigration Services (USCIS). This petition must include all relevant documentation such as proof of trafficking offense, proof of the applicant’s identity, and a statement from at least one law enforcement officer or public official confirming the applicant’s victimization. Applicants for the T visa must also submit a supporting affidavit from a law enforcement agency or public official attesting to their good moral character and willingness to assist law enforcement in the investigation or prosecution of their traffickers. Additionally, they must provide evidence that they would experience extreme hardship if they were to be removed from the United States. The USCIS will then review the petition within six months and grant or deny the application. If the application is approved, it will then move on to the U.S. Department of State (DOS) for further processing before being adjudicated by a consular officer. Upon approval, the petitioner will receive a four-year T visa. This visa can be renewed for additional four-year periods if the holder can demonstrate the continued need for assistance and protection.
