What is the process for becoming a US citizen through adopted children?
The process of becoming a U.S. citizen through adopted children in California is known as the Child Citizenship Act (CCA). This act allows children adopted by U.S. citizens to automatically become U.S. citizens. To qualify for the Child Citizenship Act, an adopted child must be under 18 years of age and legally adopted by a U.S. citizen parent. The adoption must be legally completed according to the laws of the state where the child resides. After the adoption has been finalized, the child may apply for a Certificate of Citizenship. This form is available on the USCIS website and can be submitted along with a fee. Once the Certificate of Citizenship is issued, the child is officially a U.S. citizen with all the rights and benefits that come along with that status. If the child is already a permanent resident, the U.S. citizen parent must first file a Form I-130, Petition for Alien Relative, before they can apply for a Certificate of Citizenship. To do this, the parent must provide proof that the adoption is legally valid and the child’s biological birth certificate. If the child is a minor, the parent must also submit proof that they have legal custody and guardianship of the child. Once the Form I-130 is approved, the U.S. citizen parent can then submit the Certificate of Citizenship application and fee. All documents must be submitted together for the application to be considered. The Certificate of Citizenship is usually issued within 45 days of the application being sent in. After the child is issued a Certificate of Citizenship, they then can apply for a U.S. passport or other proof of citizenship. This allows them to travel and receive all the benefits and privileges granted to U.S. citizens.
