What is a conditional green card?

A conditional green card, also commonly known as a conditional permanent resident card, is a type of green card issued to certain non-citizens who are married to a U.S. citizen. This type of green card is only valid for two years. In order for the conditional green card holder to remain a permanent resident of the United States, they must apply to remove the conditions on their green card during the 90 days before the expiration date. In order to qualify for a conditional green card, the foreign national must be married to a U.S. citizen sponsor, and the couple must jointly file an application within two years of their marriage. This means the foreign national must enter into a valid marriage in the U.S. prior to applying. Once approved, the foreign national will receive a conditional green card that is valid for two years. In order to keep their conditional green card, the couple must apply to remove the conditions on their permanent residency within the 90 days before the expiration date. This application must be jointly filed with the foreign national’s US citizen sponsor. The couple must provide evidence that they have a valid marriage and that the foreign national is not inadmissible to the United States. If the application is approved, the foreign national will receive a permanent green card. If the application to remove the conditions on their permanent residency is not filed within the 90 days before the expiration date, the foreign national’s green card will automatically expire, and they may be subject to deportation proceedings.
