What is immigration law?

Immigration law refers to the national and federal laws that govern the movement of non-U.S. citizens into and out of the United States. It also governs the legal rights, duties, and privileges of foreign nationals as they become permanent residents or immigrants of the country. In South Dakota, immigration law is mainly administered by the federal government, not the state. Federal immigration law establishes criteria for individuals who wish to become permanent residents or immigrants. This includes demonstrating that they have an employment offer, an approved petition from an employer, or a family relationship with a citizen or permanent resident. In some cases, applicants may qualify for asylum or refugee status. Immigration law also outlines border security regulations, visa requirements, the deportation of foreign nationals, and immigration court proceedings. Though South Dakota does not have its own immigration policies, the state does abide by the laws set forth by the federal government, and individuals wishing to immigrate to South Dakota must still comply with federal immigration laws. In general, immigration law exists to promote the entry of qualified people into the United States while also protecting the rights of citizens and legal residents by preventing illegal immigration. States, such as South Dakota, abide by these laws to reinforce the safety and wellbeing of their communities.
