How can I appeal an immigration decision?

In order to appeal an immigration decision, a person must file a motion to reconsider with the Immigration Court. The motion must include the reason for the appeal and the particulars of the case along with any new evidence to support the appeal. After the motion has been filed, the Immigration Judge will either reject the motion or decide to hear the case. If the motion is accepted, the Court will schedule a hearing and the person can present their evidence and arguments to the Judge. If the Judge denies the motion, the person appealing can then file a motion to reopen their case or an appeal to the Board of Immigration Appeals (BIA). The motion to reopen the case must be filed with the Immigration Court and must include the legal grounds for the appeal and any new evidence or circumstances relevant to the case. If accepted, the Immigration Judge will either remand the case for further proceedings or dismiss the motion. An appeal to the BIA can be filed after a motion to reconsider is denied. The appeal must include the argument for the appeal, a summary of the records, and the reasons why the decision was incorrect. The BIA will review the case and will either decide in favor of the appellant or dismiss the case. If the decision of the BIA is unfavorable, the appellant can then file an appeal with the U.S. Court of Appeals. The appeal must include the arguments for the appeal and the facts of the case as well as any new evidence. The Court of Appeals will make a decision based on the information presented and may either affirm the BIA’s decision or order further proceedings or revise the earlier decision. In summary, anyone wishing to appeal an immigration decision must seek legal advice and file a motion to reconsider with the Immigration Court. If the motion is denied, further motions can be filed or an appeal can be made to the BIA and then, if necessary, to the U.S. Court of Appeals.
