What is an H-1B visa and how do I apply for one?
An H-1B visa is a type of nonimmigrant visa commonly used by individuals who wish to work in the United States temporarily. The visa allows foreign nationals to work in the United States for up to three years, and can be extended in certain circumstances. H-1B visas are typically sought by employers looking to fill positions requiring highly specialized skills and knowledge that can’t be found domestically. To apply for an H-1B visa, applicants must first have a job offer from a US employer. The employer then submits a petition to the US Citizenship and Immigration Services (USCIS), and the USCIS will review the petition and decide if the applicant is eligible for the visa. If the petition is approved, the applicant must then submit their visa application to a US consulate in their home country. Then, the consulate will review the application and grant the visa if the applicant has met all the criteria. In New Mexico, the H-1B visa process is fairly straightforward, and the state does not have any additional requirements for foreign nationals who are applying for the visa. If you are a student interested in applying for an H-1B visa, it is important to speak with an immigration attorney or knowledgeable immigration advisor to ensure that you are meeting the necessary requirements and that your application is complete.
