What is a visa overstay?
A visa overstay is when someone has stayed in the U.S. beyond the period of time that is allowed on the visa. It is usually caused by a person not leaving the U.S. when their visa expires, or when their visa renewal application is denied. In California, if a student has overstayed their visa, then they may be subject to deportation proceedings. Depending on the circumstances, overstaying a visa can result in civil and criminal penalties. Civil penalties include the accrual of Unlawful Presence (time in the U.S. without permission) that can be a bar to future visa eligibility. Criminal penalties include fines and jail time. Immigration law is complex and the consequences of visa overstay can vary depending on the length of time spent in the country and other factors. It is highly recommended that students in California seek advice from a qualified immigration attorney before making any decisions about their immigration status.
