How do I obtain a work visa?

In order to obtain a work visa in Oregon, you must first be sponsored by an employer. You must then fill out an I-129 form, which is the Petition for Nonimmigrant Worker. This form must include the employer’s information, the applicant’s information, the type of visa sought, and the purpose and length of stay requested. The employer must also provide evidence that the applicant meets the criteria for the desired visa. Once the I-129 form is approved, the applicant then must submit a visa application that is specific to the type of visa sought. The application will need to include passport photos, a valid passport from your home country, and a valid birth certificate. Additional information and documentation may be required on a case-by-case basis. Next, the applicant must submit a Payment for Immigrant Visa Form, or Form I-261, which is the application fee for the particular visa type. Some visas’ application fees need to be paid directly to the U.S. Embassy or Consulate, while other visas’ fees will need to be paid through an approved third-party payment processor. Finally, the applicant must attend an in-person visa interview at a U.S. Embassy or Consulate. During this interview, the applicant will be required to provide proof of identity, answer questions, and provide documentation to prove the information they provided in the application. After the successful completion of the interview, the visa will be issued and can be used to legally work in Oregon.
