What is a family-based petition?
A family-based petition is a request to the United States Citizenship and Immigration Services (USCIS) for a relative to come to the United States from another country. This petition is sometimes referred to as an immigrant visa petition, and is used when an individual wants a close relative to become a resident of the United States. In Texas, family-based petitions are used to bring family members into the state, as well as to help a relative obtain permanent legal residency. When filing a family-based petition, the petitioner must provide specific evidence that proves the relationship between them and the potential immigrant. This includes providing documentation that proves the petitioner is a U.S. citizen, as well as evidence of the relationship such as birth certificates, marriage certificates, or other legal documents. Additionally, they must provide the immigrant’s personal documents such as birth certificates, passports, and other necessary documents needed to prove their identify and citizenship. The USCIS will review the petition and consider factors such as family ties, financial means, and the individual’s immigration history. If the petition is granted, the potential immigrant will be issued a green card that will allow them to stay and work in the United States and will eventually be able to apply for U.S. citizenship. Family-based petitions are an important part of the immigration process in Texas and throughout the United States. These petitions allow close relatives to come and live in the United States, providing a safe and secure home for individuals and families.
