What is a family-based petition?
A family-based petition is a type of immigration process which allows an eligible relative of a US citizen or permanent resident to become a lawful permanent resident. This petition is usually filed by the citizen or permanent resident, known as the petitioner, for their family member, known as the beneficiary. The petitioner must prove that they have a valid family relationship with the relative they are filing for, such as a spouse, parent, sibling, or other family member. If the petitioner is a US citizen, they will be required to provide evidence that they are over the age of 18 and can provide financial support for the relative they are filing for. In West Virginia, the petitioner must file the family-based petition on a specific form, accompanied by evidence of the family relationship, an Affidavit of Support, and the fees required by the US Citizen and Immigration Services.
