What is labor certification?

Labor certification is a process by which U.S. employers can apply to the U.S. Department of Labor (DOL) to hire international workers. The goal of labor certification is to ensure that U.S. employers are not hiring foreign workers at a wage lower than what U.S. workers with the same qualifications would earn, and to ensure that the international worker fulfills a role that a qualified U.S. worker could not. In Florida, labor certification is handled through an employer-sponsored program called Program Electronic Review Management (PERM). This program allows employers to file labor certification applications electronically through an online portal. To be eligible for labor certification, employers must first demonstrate that there are no qualified U.S. workers available for the position. This usually requires the employer to post a job advertisement for a certain period of time, provide documentation of their recruitment efforts for U.S. workers, and show that their wages meet or exceed the prevailing wage for the position. Employers must also demonstrate that their foreign worker is either a professional or a specialized worker, meaning they have a high level of education and/or training, possess relevant experience and technical skills, and be able to fulfill the duties of the position. The foreign worker typically has to demonstrate that they are legally allowed to work in the U.S. and satisfy other requirements. Once the employer proves they have met the labor certification requirements and filed the application, the DOL reviews it and determines whether to approve or deny the application. If approved, the employer can move forward with their application to the U.S. Citizenship and Immigration Services and potentially bring the international worker to the U.S. to fill their position.
