What is labor certification?

Labor certification is a process used by employers in Maine who wish to hire a foreign worker to fill a job position. The process requires an employer to obtain a certification from the Department of Labor that no US workers are able or willing to accept the job offered by the employer. This process requires the employer to provide proof that the job is not being offered to a foreign worker to replace a US worker or to undermine working conditions or wages for US workers in the same occupation. The labor certification process in Maine involves advertising the job position in both local and national publications. The employer must also take other steps to recruit US workers for the job being offered. If no US workers are able or willing to accept the position, the employer can file a labor certification application with the Department of Labor. The Department of Labor will approve the application if it can be demonstrated that hiring a foreign worker would not adversely affect the wages and working conditions of US workers in the same occupation. Once the labor certification is approved, the employer can then proceed with the visa petition process for the foreign worker. This includes filing a petition with the United States Citizenship and Immigration Services to begin the process of obtaining a visa for the foreign worker. The entire labor certification process is necessary in order for a foreign worker to legally enter and work in the United States.
