What is the process for renewing a visa?
In Minnesota, the process for renewing a visa depends on the type of visa held by the foreign national. Those with certain types of temporary visas, such as an H-1B or F-1, may be able to extend their stay without leaving the United States. However, if the visa has expired and they still wish to remain in the country, they must apply for a new visa. The first step in this process is to file Form I-539, which is the Application for Extension/Change of Status. This form must include a copy of the original visa, any supporting documentation, and the appropriate filing fee. It should be sent to the United States Citizenship and Immigration Services (USCIS) office. After the form is sent, the foreign national must pass a new background check and be approved by USCIS before the extension/renewal can be granted. If the visa is approved, the foreign national may stay in the United States during the duration of their visa. If the visa is not approved, the foreign national will be required to leave the country. Depending on the situation, they may be eligible to re-apply for a visa or receive an expedited application. No matter the situation, it is important to follow any and all instructions provided by USCIS and/or the embassy/consulate. A failure to do so can result in the denial of a visa renewal. It is also important to note that any visa holder should keep their passport current and valid throughout their stay in the United States.
