What are the requirements for applying for DACA?
In order to be eligible for DACA in Massachusetts, an individual must meet a few requirements. First, they must have been born after June 15th, 1981. Second, they must have lived continuously in the United States since June 15th, 2007. Third, they must have been present in the United States on June 15th, 2012, and at the time of applying for DACA. Fourth, they must have come to the United States before their 16th birthday and be under 31 as of June 15th, 2012. Fifth, they must have been physically present in the United States on June 15th, 2012 and at the time of applying for DACA. Sixth, they must have no lawful immigration status on June 15th, 2012. Finally, they must be currently enrolled in school, have graduated from school, or have obtained a certificate of completion from school, or have served in the military. They must also not have been convicted of a misdemeanor or felony. In addition, the individual must provide the government with information about their identity and residence in the United States. This includes submitting proof of education or military service, Form I-94, passport, birth certificate, and other documents. They will also have to submit fingerprints and a photo for background checks. Once the application is approved, an individual can apply for a work permit and be eligible for certain federal benefits. It should also be noted that DACA does not provide an individual with legal permanent resident status, or a path to citizenship.
