What are the requirements for applying for DACA?

The Deferred Action for Childhood Arrivals (DACA) program offers a form of protection for undocumented immigrants living in Kansas. In order to be eligible for DACA, applicants must meet certain criteria. First, applicants must have been under the age of 31 before June 2012 and must have been brought to the U.S. before their 16th birthday. Individuals who turned 31 after June 2012 or were brought to the U.S. after their 16th birthday are not eligible for DACA. Second, applicants must have continuously resided in the U.S. since June 15th, 2007. Continuous residence means that the individual must have been present in the U.S. for longer than short trips. Third, applicants must have been present in the U.S. on June 15th, 2012 and must not have left the U.S. after that date. Fourth, applicants must have been enrolled in school, must have obtained a GED, or must have been honorably discharged from the armed forces. Fifth, applicants must not have any felony convictions, multiple misdemeanors, or any other criminal activity that would make them ineligible for the DACA program. Finally, applicants must meet strict documentation requirements, including valid travel documents or other proof of identity and residence. Applicants who meet all the requirements for DACA may apply for the program. However, it is important to remember that DACA does not offer a permanent solution to immigration status in the U.S. Immigrants should consult with an immigration attorney to determine their best course of action.
