What is the process for filing an application for an O-1 visa?

The O-1 visa is a nonimmigrant visa that is available for people who demonstrate extraordinary ability or achievement in the sciences, arts, education, business or athletics, or who have a demonstrated record of extraordinary achievement in the motion picture or television industry. In Idaho, the process for filing an application for an O-1 visa begins with gathering the relevant documents. This includes evidence of the person’s extraordinary ability or achievements, such as awards and letters of recommendation, as well as a letter from the petitioner – a U.S. employer or agent – that describes the job duties and the need for the person’s services. Additionally, applicants must fill out and file Form I-129, Petition for a Nonimmigrant Worker. Once all the necessary documents are collected and submitted, a consular officer at the U.S. Embassy or U.S. Consulate abroad, or a Customs and Border Protection officer, must interview the applicant and review the documentation. Approval of the visa is based on the officer’s evaluation of the applicant’s qualifications and suitability for the role. The application may take up to three months to process, and, if successful, will grant the applicant either a one-year (or three-year) period of stay in the U.S. An O-1 visa is valid for a specific period of time and must be renewed for a person to continue living and working in the U.S.
