What is the process for filing an application for Temporary Protected Status (TPS)?

The process for filing an application for Temporary Protected Status (TPS) in Kansas is similar to other states in the U.S. To qualify for TPS, an applicant must be a national of a country designated for TPS, or must have no nationality but last habitually resided in the designated country. Additionally, the applicant must have been continuously physically present in the U.S. since a certain designated date and must continuously reside in Kansas. To apply for TPS, applicants must complete the Form I-821, Application for Temporary Protected Status. This form is available online or through the USCIS and can be submitted by mail or electronically. Along with the application, applicants must submit supporting evidence proving they meet all of the eligibility requirements for TPS. This may include documents that prove their identity and their nationality, or their residence in the designated country. The application must also include biometric services fees. This fee covers the cost of background and security checks and other processing services. If the application is approved, applicants will receive an Employment Authorization Document (EAD), which will allow them to work in the U.S. for the duration of their TPS status. Once all of the required documents and fees have been submitted, the USCIS will review the application and notify the applicant of a decision. Depending on the length of time the application takes to process, an applicant may be able to obtain work authorization while they wait for a decision. It is important to note that not all applications for TPS are approved; however, applicants who are denied can appeal the decision.
