What are the procedures for filing an application for asylum?
In Kansas, if you wish to apply for asylum, the procedures are different depending on whether you are already in the United States or are applying for asylum from outside the United States. If you are already present in the United States, you must first file Form I-589, Application for Asylum and Withholding of Removal, with U.S. Citizenship and Immigration Services (USCIS). USCIS will then review the application to determine if you meet the eligibility criteria for asylum. If you meet the criteria, you may be scheduled for an interview with an asylum officer. The asylum officer will review your application and ask questions to determine if you are eligible for asylum. For those applying from outside the United States, you must first file Form I-590, Refugee/Asylee Relative Petition, with the U.S. Department of Homeland Security. This form is used to petition for a family member to be allowed to travel to the U.S. and apply for asylum. The applicant must then attend an interview with the U.S. Embassy. If the applicant is found to meet the criteria for asylum, they will then be granted permission to travel to the U.S. to file a Form I-589 with USCIS, and the asylum process will continue as described above. In either scenario, an experienced attorney can help you navigate the asylum process and help ensure that all forms are filed properly in order to determine your eligibility for asylum.
