What are the procedures for filing an application for asylum?

In Mississippi, anyone who is seeking asylum must complete and file Form I-589, Application for Asylum and for Withholding of Removal, with the U.S. Department of Homeland Security. The applicant must include several pieces of documentation, including an official birth certificate, passport, and/or other documentation that establishes identity and nationality, evidence of persecution or potential persecution, and police or military documents. Once the application is received, an asylum officer will review the application and make a determination on whether the applicant should be granted asylum. Generally, the applicant will be interviewed to determine whether they are eligible for asylum and if so, the officer will recommend that the asylum be granted and the application approved. If the asylum application is approved, the applicant must attend a biometrics appointment. During this appointment, the applicant’s fingerprints and photos will be taken and a background check completed. Following the biometrics appointment, the applicant will be granted asylum and issued an Employment Authorization Document. Once all the necessary documents have been collected and the biometrics appointment completed, the applicant will be able to apply for lawful permanent resident status and eventually citizenship. However, depending on current legal conditions, some applicants may be ineligible for certain benefits.
