What are the restrictions for entering the U.S. on a visa?
Entering the United States on a visa is a privilege, but the process is not without restrictions. The U.S. Department of State sets forth specific criteria that applicants must meet in order to be eligible for a visa. Most visa applications must establish that the applicant has a residence and other ties outside of the United States that they will not abandon. Applicants must demonstrate strong financial resources, good moral character, and clear intent to comply with the terms of their visa. In addition to these criteria, the specific visa type determines additional restrictions. For instance, tourists must not intend to stay in the United States for more than 90 days, and they must demonstrate strong ties to their home country. On the other hand, students must demonstrate their acceptance to a valid academic institution and must show evidence of sufficient financial resources for their stay in the United States. Business and professional visas generally require significant evidence of professional credentials and sponsorship from U.S. employers. In New Mexico, visitors from certain countries may also be required to apply for a visa waiver program. This program allows eligible visitors to enter the United States for up to 90 days without a visa. The waiver is generally for individuals from countries participating in the Visa Waiver Program who have a valid passport and who intend to visit the United States for business or pleasure, not to work or study. The Visa Waiver Program does not apply to all visa types, and the eligibility of applicants must be determined on a case-by-case basis.
